Days in the Life of TLC" Sweepstakes |
| 1.
ELIGIBILITY
Sweepstakes is offered only to legal residents of the United States and the District of Columbia, who are at least 18 years of age at the time of entry. Sweepstakes is void in Puerto Rico and where prohibited. Employees, directors, and officers of America Online, Inc., T-Mobile (collectively, "Sponsors") and NewWorldIQ ("NWIQ") and their respective parents, subsidiaries, divisions, affiliates, and the immediate family (defined as parents, children, siblings and spouse or life partner) of each such person, together with those whom such employees are domiciled are not eligible. By entering, you agree to be bound by these Official Rules and the decisions of NWIQ, which shall be final and binding in all respects. 2. TIMING The Sweepstakes begins on October 9, 2002 at 12:00:00am Eastern Time (ET) and ends on November 15, 2002 at 11:59:59pm ET ("Sweepstakes Period"). 3. ENTRY To enter, visit http://jump.iq.com/jump14/tlc/index.html, click on the "Enter Now" button and follow the Sweepstakes registration steps, which include providing your full name, mailing address, home telephone number (including area code) and e-mail address. After providing this information, click the "Submit" button. Limit: One (1) sweepstakes entry per person/email address. Entries received prior to or after the Sweepstakes Period shall be disqualified. All other entry attempts are void. NWIQ's computer will be the official clock of the Sweepstakes.
Winners will be selected by random drawing on or about November 18, 2002 from all eligible entries received during the Sweepstakes Period. Winners will be notified by e-mail, telephone, or overnight courier within approximately five (5) business days of the drawing. Drawing will be conducted under the supervision of NWIQ, an independent judging organization, whose decisions on all matters related to eligibility and drawing protocol shall be final. 5. PRIZE/ODDS One (1) Grand Prize consisting of: A trip for three (3) to meet TLC in their hometown, Atlanta, GA, including roundtrip coach class air transportation for three (3) from the metropolitan airport nearest the winner's home (airport and carrier to be determined by Sponsors); three (3) day, two (2) night stay at the Embassy Suites Buckhead or similar property (one room, triple occupancy); land transfers from the arriving airport to and from the hotel; hairstyling and make-up application or men's facial for three (3) at an Atlanta salon; meet and greet with TLC band members; a list of favorite TLC hang-outs and $1,000spending money. Travel must be completed by January 31, 2003. Winner will be given two weeks notice of TLC's availably for a meet and greet. If winner is unable to travel during this time, he or she may elect to take the trip to Atlanta but will forfeit the opportunity to attend a meet and greet. Approximate Retail Value ("ARV") is $4,500. Actual value of grand prize will vary based on place of origin and airfare fluctuations. If the major airport nearest the winner's residence is Hartsfield International Airport, the Grand Prize will not include air transportation or land transfers to the hotel and no substitution or compensation will be provided. Winner and guests must travel together on the same travel itinerary and on dates specified. Winner's travel companions must be at least 18 years of age or be traveling with a parent or legal guardian. Flight details are subject to space availability and airline carrier's regulations and conditions apply. The trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Any picture identification requirements associated with air travel are the winner's and guests' responsibility. Sponsors are not responsible for lost or mutilated travel certificates and none will be replaced. Any portion of a prize not accepted by winner will be forfeited. All other expenses not specified herein (including taxes, gratuities, meals and non-specified ground transportation) are the sole responsibility of the winner. All specifics of prize are in the Sponsors' sole discretion. Odds of winning depend on the number of eligible entries received. No assignment, transfer, cash redemption or substitution of prize is permitted except by Sponsors, who, at their sole discretion, may substitute a prize of equal or greater value should any stated prize become unavailable. All applicable taxes are the sole responsibility of winner. The prize will be awarded. 6. MEET AND GREET The time and location of the meet and greet with TLC are determined solely by Sponsors and are subject to availability; no alternate dates or locations arrangements are available. Sponsors assume no responsibility for any canceled or delayed meetings. Sponsors' sole liability for any such cancellation or unavailability for any reason as of the time of prize award is to offer eligible Grand Prize winner the travel, salon and cash portions of the prize exclusively.
Information collected from entrant is used only for the purpose of the prize drawing and to notify winners, and will not be re-used, sold or shared in any manner by Sponsors or by NWIQ or any third parties. By entering this Sweepstakes, all entrants agree to be bound by all applicable U.S. laws as well as these Official Rules. Grand Prize Winner and travel companions must complete, execute and return an Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity Release (collectively, the "Affidavit") within ten (10) days of notification. Noncompliance with this time period (or NWIQ's determination that the Grand Prize Winner is not eligible) will result in disqualification, and an alternate Grand Prize Winner will be selected. Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner. Alternate winners are selected at random from the remaining eligible entries. Prize will only be delivered to addresses within the United States. Where permitted by law, Grand Prize Winner grants to Sponsors and those acting pursuant to the Sponsors' permission, the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the Internet, at any time and for perpetuity, the Grand Prize Winner's name, city/state, portrait, picture, voice, likeness and biographical information as news or information and for advertising, trade, public relations and promotional purposes without additional consideration, and without review, notice or approval. By accepting a prize, winners release and agree to hold harmless Sponsors and NWIQ and their respective parents, subsidiaries, divisions, affiliates, distributors and suppliers, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind or nature to person, including death, and damage to property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prizes, participation in any Sweepstakes related activity, or participation in this Sweepstakes. Sponsors and NWIQ reserve the right, at their sole discretion, to disqualify any individual found, in their sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or web site; to be in violation of the Terms of Service of any of their web sites; to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed, third party, or like entry methods will void all entries, and any participant using any such method will be disqualified. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Sponsors may prosecute any fraudulent activities to the full extent of the law. 9. LIMITATIONS OF LIABILITY Sponsors assume no responsibility for lost, late, incomplete or misdirected entries; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, or service provider/Internet/web site/use net accessibility or availability, traffic congestion, or unauthorized human intervention or the incorrect or inaccurate capture of entry information, or the failure to capture any such information. Sponsors and NWIQ are not responsible for any incorrect or inaccurate information, whether caused by web site users, or tampering or hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site. Sponsors and NWIQ are not responsible for injury or damage to entrant's or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. If, for any reason, this Sweepstakes, or any part thereof, is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsors and NWIQ, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the winners in a random drawing from eligible entries received prior to the action taken. Sponsors and NWIQ are not responsible for any warranty or guarantee with regard to the prizes or any portion of the prizes. This includes, but is not limited to, the fitness of the prizes for particular purpose. 10. DISPUTES Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsors and NWIQ in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Virginia, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
